General Terms & Conditions of Sale

1 – Purpose and acceptance of terms and conditions

LANCIOR Paris website (hereinafter the « Site » ) is an e-commerce website accessible via the Internet at www.lancior.fr. It is open to any user of this network (hereinafter referred to as « User »). It is edited by the company LANGE SAS (hereinafter referred to as « Seller » ), a simplified joint stock company with a capital of 40,000 Euros, whose registered office is located at 25, Boulevard des Italiens 75002 Paris – France, registered with the Trade and Companies.
Registry under number 479 372 518 ( hereinafter referred to as « Seller » ).

The website allows Lange to offer for sale cosmetics to Internet users browsing the webSite (hereinafter referred to as « Users »). For the purposes hereof, it is agreed that the User and Lange will be collectively referred to as the « Parties » and individually as « Party » , and the user who validated an order will be referred to as « Buyer ». The rights and obligations of the User apply to Buyer. Ordering product offered on the Site requires consultation and express acceptance of these terms and conditions, but this acceptance is conditioned by a handwritten signature from the user.
It is noted that the user can save or print the present general conditions of sale, provided that they do not change.
These general conditions are valid from September 1, 2018. Lange reserves the right to modify these General and Specific Terms and Conditions at any time without notice, provided that such changes will not apply to bookings and orders previously accepted and confirmed by the Buyer.
These conditions apply to the exclusion of any other document.

2 – Products marketed www.lange.fr

All offers available on the Site are limited to mainland France and Corsica. Buyer may , prior to his order, take note on the Site Lancior-paris , essential characteristics of the products they wish to order.
The bid including promotional offers are valid until they are announced on the
website.

3 – Prices of products sold on the site

The prices listed on this Site are in Euros including all taxes and are subject to change during the year , provided that the products ordered are charged at prevailing prices at the time of the order.
They do not include shipping costs, charged in addition to the price of products purchased according to the amount of the order. Shipping charges are shown before the registration of the order by the Buyer.
Prices include value added tax (VAT) applicable on the date of the order and any change in the applicable rate will be reflected on the price of products sold by Lange in the Site.

4 – Controls

Any order implies acceptance, without limitation or qualification these terms and conditions of sale.
Buyer agrees that the registration of the order of Lange systems as proof of the nature of the agreement and the date.
The amount of each order is limited to the amount of EUR 1000 per order. In addition, the same reference product can not be ordered for an amount greater than 10 items per order.
When the order is confirmed by clicking the « Complete Order » button , the Buyer hereby accepts it and these terms and conditions of sale. The order can be printed.
Upon registration of the order, a detailed receipt thereof will be sent to the Buyer at the email address that will be shown.
This acknowledgment will specify the exact amount charged and the terms of delivery of the order.
This acknowledgment is accepting the order and validate the transaction subject to the payment of the order.
In case of unavailability of one or more products after placing the order, you will be notified by e -mail. The amount of your order will be recalculated and you will be charged the new rate, minus the missing products. If your order is completely unavailable you will be notified by email and you will not be charged.
You can also cancel an order placed on the website by contacting customer service at info@lange.fr. If customer service informs you that the order has been processed, you cannot cancel it then you should refuse the package upon receipt of your order.

Lancior, however, reserves the right to suspend or cancel any order from a buyer with whom there is a dispute over payment of a previous order, or for any other legitimate reason including taking the unusual nature of the order.

5 – Payments

All orders are payable in Euros.
To set the order, the Buyer has the following payment method: credit card.
Credit cards accepted on site are: Visa, Master Card and American Express.
Payments via PayPal are also accepted.
Buyer guarantees that Lange has the required permission to use the payment method he chose, when saving the order.
Lancior reserves the right to suspend or cancel any order and / or delivery, whatever its nature and level of execution in case of non- payment of any sum due by the Buyer or in the case of payment incident.
Penalties in an amount equal to the legal interest rate plus five points are automatically applicable to amounts outstanding at the end of a period of ten days from the date of invoice.
In the context of the fight against Internet fraud, information about your order may be sent to any competent authority for verification.
To ensure the security of credit card payment, the Purchaser shall send to the Paypal security code (CVV ) of his credit card.
PayPal supports payments, refunds and releases flows.
Payment security on the site is provided by Paypal.

6 – Delivery of orders

The products will be delivered to the address specified by the Buyer on the order by French Post for orders under 75 Euros and by express (UPS, DHL,TNT,Fedex) for orders above 75 Euros.
Delivery will be made in an average of 2 to 5 days from receipt of order, depending on the shipping method selected and a maximum within 30 days of receipt of order.

7 – Legal warranty

The buyer benefits from the provisions of the legal guarantee of conformity and the legal guarantee against hidden defects.
In case of lack of conformity of the product, in particular due to a defect or error in the references supplied , the Purchaser may elect to return the product to Lange and obtain a refund.
Return costs will be reimbursed by Lange at the request of the Buyer.

You have a period of two years from the date of delivery of the Product to take action under the legal guarantee of conformity. In this case, you may choose between repairing or replacing the Product, subject to the cost conditions set out in Article L217-9 of the Consumer Code.
For contracts concluded after 18 March 2016, You are exempted from proving the existence of the Product’s lack of conformity during the twenty-four (24) months following the delivery of the Product. For contracts concluded previously, the defect is presumed for six (6) months.
You are reminded that the legal guarantee of conformity applies independently of any commercial guarantee that may be granted to you by LANGE SAS.
In addition, You may decide to invoke the guarantee against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code. In this case, You may choose between rescission of the sale or a reduction in the purchase price in accordance with Article 1644 of the Civil Code.

8 – Right of withdrawal

The Purchaser shall have a period of 14 days from the date of receipt to return at its expense, the products ordered to refund.
Reimbursement will be made by any means of payment chosen by the Buyer expressed after exercising his right of withdrawal, no later than 30 days after the date on which the right is exercised.

9 – Instructions for returning products

Whatever the reason for returning the products to Lange, it is advisable to Buyer follow these instructions in order to facilitate the processing of said return:
1. Use the original packaging to return the product.
2. Complete and attach the Returns to detach from the Delivery.

10 – Retention of title

Lancior retains full ownership of the goods sold until full payment is received , in principal, including fees and taxes.

11 – Responsibility

Lancior will not be held liable for breach of contract in case of out of stock except in cases of non- promotion price for disposal of stocks, or in case of unavailability of the product due to a case of force majeure.

Lancior disclaims all responsibility:
– For any site interruption;
– For any bugs;
– For any damage resulting from fraudulent intrusion by a third party leading to a modification of the information available on the site;
– And more generally for any direct or indirect damage, whatever the cause, origin , nature or consequences, including without limitation any loss of profits , goodwill, data or other intangible losses that may result from anyone accessing the Site or inability to access or reliance upon any information coming directly or indirectly from it.

12 – Intellectual Property

In accordance with laws governing literary and artistic property rights or other similar rights, this site and all the elements, trademarks, designs, models, photographs, text, graphics, logos, animated or not , with or without sound, graphics etc.. located on this site and their compilation are the exclusive property of Lancior, it does not grant any license or right other than to consult the site.
Reproduction or use of all or part of these elements is only authorized for the purposes of information for personal and private use , any reproduction and any use of copies made for other purposes is expressly prohibited. Neither the Site (or any part), nor its content, nor the marks may not be used, reproduced , duplicated, copied, sold , resold, accessed, modified, or otherwise exploited , in whole or in part for any purpose whatsoever without the prior written permission of Lancior.
Any other use constitutes infringement.

13 – Applicable Law

Sales Lancior products are subject to French law.

14 – Computer and Freedom

The information collected is subject to a data processing for sending a newsletter and / or management control of the Buyer.
The recipients of the data are Lancior and its contractors.
The Buyer has a right to access, rectify, oppose and delete data relating to Lancior by sending a email to info@lange.fr
